A piece of legislation that was sponsored by State Representative Dwight Kay and was passed as a law in August will go into affect on January 1st, 2012. The measure known as HB3417 amends the Unified Code of Corrections to ensure that probation departments receiving offenders from another circuit court have the authority to assess the applicable $50 fee.

Representative Kay says that the measure makes sure there isn't any extra burden placed on a county when they receive a person who is on probation when they are transferred from another jurisdiction.

Previously the money collected from defendants was placed into the working cash fund of a county, under the new law it will be deposited in the probation and court services fund.
