The legal fight over the upkeep of a giant cross in southern Illinois now includes another setback for the plaintiff – atheist-activist Rob Sherman of Buffalo Grove. A federal appeals court has upheld a lower decision to throw out Sherman’s suit over taxpayer money being used for Bald Knob Cross.

“The restoration of the cross was paid for … in part by public funds,” said Sherman. “What I want is for the 20,000 tax dollars to be returned to the taxpayers because (it’s) not the job of taxpayers to pay to advance religion.” He says while he was found not to have the proper standing to sue, he’s encouraged that the courts have not spelled out that his point is incorrect. He says he would like to go to the U. S. Supreme Court.
