A comeback may be in store for daily fantasy sports in Illinois.


In December, Illinois Attorney General Lisa Madigan declared that online gambling on daily fantasy sports sites was illegal. State Rep. Mike Zalewski, D-Riverside, is a sponsor of a bill to make the games legal in Illinois, and said he agreed with Madigan.


“She said at the end of her opinion that the legislature should write a law to legalize it, and that’s effectively what we’ve done,” Zalewski said.

Zalewski said some lawmakers raised concerns about whether the bill did enough to ensure children would not gamble on the sites.


“Members worried that minors could continue to play even though the testimony from the companies was that they invested in software to prevent that from happening,” Zalewski said. “Whenever you have a new technology that enters the marketplace like this, I think it’s incumbent upon lawmakers to impose safe and reasonable restrictions to make sure that is properly regulated and to make sure people are appropriately safe when they choose to play.”


The bill would allow people 21 and over to participate, limit players to $3,000 and give the Illinois Gaming Board the authority to regulate and tax the companies.


The bill awaits a vote in the Illinois House.
