An area attorney has filed a class-action lawsuit against former Madison County Treasurer Fred Bathon, Madison County, and several others linked to the corrupt tax sales that landed Bathon a guilty conviction. John Barberis and Steve Gicoletto filed the class action in Madison County Circuit Court on Thursday.
Barberis says it seems likely that more county officials other than just Bathon (pictured) knew what was going on with illegal delinquent tax auctions.
He says it is likely as the class action progresses, more public and private parties and corporations will be added to the class. Bathon pleaded guilty earlier this month to violating the Sherman Antitrust Act. It was revealed in court that for tax sales conducted between 2005 and 2008, Bathon structured delinquent property tax sales in such a way that eliminated competitive bidding and allowed the tax buyers to engage in price fixing by only bidding the statutory maximum interest rate of 18%.
