Paul SchimpfThe Republican candidate for Illinois attorney general wouldn’t defend the state’s pension reform law as it stands now.  Paul Schimpf has said before that he believes the law violates the Illinois Constitution.  Schimpf says if he were in Lisa Madigan’s position, he would try to get certain provisions removed instead of defending the whole law.  “The provision that cuts the cost of living adjustment—that’s the one I think is blatantly unconstitutional, and I would not defend that provision,” Schimpf said.

Madigan has argued that the law exercises the state’s police powers. Schimpf compares that opinion to arguments made by the administration of former George W. Bush about suspending constitutional provisions during emergencies.
