An Alton man will head to court next month to face charges of felony sexual exploitation of a child following an incident on a supermarket parking lot in April. 24-year-old Matthew A. Banks of the 2400 block of Kohler Avenue will appear in court again on September 8th after a judge on Thursday set a trial date.
County prosecutors and Banks’ attorney appeared in court yesterday to argue whether or not a jury could hear about Bank’s previous convictions, including one for domestic battery in 2011 when he was sentenced to four years in prison. Banks’ attorney also asked that they be able to argue that another person committed a similar offense in Godfrey but was only charged with a misdemeanor. Circuit Judge Kyle Napp agreed on both counts in favor of the defense. Banks is accused of pulling his car up to another vehicle that was parked on the lot at Schnucks in Godfrey on April 18 and exposed himself to a four year old girl.
