A Republican lawmaker wants to update a state regulation that is keeping a local VFW from using a building designed specifically for patrons who want to smoke. Dwight Kay of Glen Carbon was asked to look into the situation at the Collinsville VFW where they can’t use a building for smoking due to a rule change enacted last year.
Kay says the group spent $80,000 to comply with state regulation regarding smoking and was within the law until the rule change about an “enclosed area” made their building non-compliant.

Kay’s bill would exempt any structures that were built, before the rule change, that are specifically used for smoking as long as they are designated as such. HB5029 was approved in committee on Monday.
