A judge says the city of Alton must act first before she can rule on a temporary injunction over a suspended police captain.  Madison County Judge Barbara Crowder says the Alton Civil Service Commission must make the decision on the matter of paying an Alton Police Captain following his most recent suspension before she can offer her opinion.

The attorney for Captain Scott Waldrup had asked a judge to rule on the matter of his suspension without pay, but Judge Crowder says the Alton Civil Service Commission must first make a decision as to whether Waldrup can be suspended without pay.  The suspension without pay dates back to February 19th, when Alton Police Chief Jason Simmons took the action over Waldrup’s reported involvement in the alleged disposal of evidence by another police officer.  Waldrup’s attorney has argued a suspension without pay creates a burden for him and his family.  The Alton Civil Service Commission is expected to hear the matter at its next meeting on April 1.
