A bill introduced by Republican State Representative Dwight Kay of Glen Carbon would address the problem of "double-dipping" by asbestos claimants seeking compensation from trusts of bankrupt companies, as well as filing civil lawsuits against current businesses.  Madison County has the busiest asbestos docket in the nation, and Kay wants to see some safeguards put in place to keep people from taking more than what is theirs.

He says it is vital to make sure those that deserve compensation get it.

Kay comments

HB153 requires that claimants in asbestos tort actions to make certain disclosures pertaining to asbestos trust claims that have been submitted to asbestos trust entities for the purpose of compensating the claimant for asbestos exposure.
