As New Year’s follows Christmas, as May flowers follow April showers, so too do lawsuits from retiree groups follow passage of Illinois' pension restructuring law.

The fifth one, filed Friday in Urbana, comes from the State Universities Annuitants Association. Executive director Linda Brookhart says she believes the groups representing current and future retirees will have the upper hand: “I think that there is a good possibility that at least most of the lawsuits will win; meaning, those that are represented will win,” she said. “Those that are new to the systems – we might have a little more difficulty winning for them.”

Brookhart says a state which does not honor its contracts will have a hard time attracting employees, including, in the case of the universities, top professors.

The plaintiffs contend the law is unconstitutional because it’s a reduction of benefits.
